Buying property in Mexico as a foreigner is perfectly viable and well-regulated. The process takes 6-16 weeks from agreeing on price to signing the final deed. Here's each step explained.
What Is Step 1: Define Your Objective and Budget?
Before searching, clarify: personal use, vacation rental or both? Total budget including closing costs (4.5-6% extra)? Cash purchase or financing needed? Investment horizon?
What Is Step 2: Search With a Trusted Agent?
Mexico has no unified MLS like the U.S. Each agency has its own inventory and many properties aren't publicly advertised. Work with an agent experienced with foreign buyers who has access to multiple developers and private sellers.
What Is Step 3: Offer and Letter of Intent?
Present a purchase offer establishing the offered price, payment terms and estimated closing date. If accepted, proceed to the promissory purchase agreement.
What Is Step 4: Promissory Purchase Agreement?
This formal agreement establishes price and payment terms, deed timeline, contingency conditions, penalties for non-compliance and a deposit (typically 5-10%). Have your attorney review it before signing.
What Is Step 5: Legal Due Diligence?
Your attorney verifies: certificate of no encumbrances, seller's deed, property tax current status, construction permits (pre-sale), and trust status. Takes 1-3 weeks.
What Is Step 6: Bank Trust (Fideicomiso) Setup?
The notary initiates the bank trust with your chosen bank. Documents required: valid passport, proof of address, Mexican tax ID (notary can help), source of funds declaration. Takes 2-6 weeks.
What Is Step 7: Fund Transfer?
Funds transfer to a Mexican notary-supervised escrow account. Anti-money laundering compliance is verified.
What Is Step 8: Final Deed Signing?
Before the public notary, both parties sign the purchase deed. The notary reads the full content, verifies identities, withholds applicable taxes and registers the deed in the Public Property Registry. You receive the keys.
What Is Step 9: Public Registry?
After signing, the notary registers the deed — a process taking 4-8 additional weeks. The registered deed is your final ownership document.
What Is Frequently Asked Questions?
Do I need an attorney or is the real estate agent enough?
Strongly recommend your own attorney independent of the agent. The notary is a neutral public official, not your personal advocate.
Can I complete the process without being in Mexico?
Yes, through a power of attorney. A local representative can sign on your behalf.
In what currency is the deed signed?
Mexican law requires deeds in pesos, even if the agreed price was in USD. The official exchange rate on signing day applies.
